When was the last time you took a good, hard look at your estate plan? If you’re like most people, it was probably the day you signed it. It’s easy to file it away and assume everything is taken care of. But estate planning isn’t a one-and-done process. Life happens. Families change. Laws evolve. What was perfectly adequate five or ten years ago might not reflect your current wishes, your family structure, or even be legally enforceable under current state laws. This is why I always tell my clients that reviewing your estate plan regularly isn’t just a good idea, it’s absolutely essential.
Think of your estate plan like a house. When you first move in, everything is fresh and new. The roof is solid, the plumbing is reliable, and the foundation is strong. But over time, things shift. Roof shingles crack, pipes leak, and sometimes, you decide to knock down a wall or expand a room. Just like you wouldn’t ignore a leaky roof, you shouldn’t ignore the wear and tear on your estate plan. Regular check-ups are necessary to ensure it still fits your life and provides the protection you intended.
Key Moments to Review Your Estate Plan:
- Family Changes: Marriage, divorce, new children or grandchildren, and the passing of loved ones.
- Financial Changes: Buying or selling property, business ownership changes, or inheritance.
- Legal Changes: Updates to state or federal laws, new regulations, and changes in tax law.
- Health Changes: New diagnoses, long-term care needs, or significant changes in health status.
- Relocation: Moving to a new state with different probate and estate planning laws.
Even if there haven’t been any major life events, I recommend pulling out your estate plan every one to three years just to make sure everything is still aligned with your wishes. I often hear from clients that it’s been over a decade since they even thought about it. When we finally sit down and review it, they’re surprised at how much is out of date. Guardians named for their children are no longer appropriate, assets listed in the will have been sold, and trusts aren’t fully funded. A quick review every few years can prevent those kinds of surprises and make the administration of your estate so much easier for your loved ones.
Why Regular Reviews Matter:
- Peace of Mind: Know that your loved ones are protected and your wishes are honored.
- Avoiding Family Disputes: A clear, updated plan reduces confusion and tension among family members.
- Minimizing Taxes and Fees: Proper planning helps avoid unnecessary costs and preserves more of your legacy.
- Preventing Legal Issues: Outdated documents can lead to probate complications and legal battles.
